Wrong size

I bought size 40, I buy them from Walmart all the time, the size was not the same or even close to the same. It's more like 30-32, I couldn't even wear it. I just put them in a drawer in case I lose 40 pounds to fit in. BTW I didn't even wash it so it's not shrinkage just bad marks.
