I read some reviews before buying. I have a 38" waist and it's small, but a 40" waist can get loose quickly. I bought XXL and swim in it. I can wear them, but I have to tug on the laces to tighten them. The mesh insert is too large. I think I would be better with XL. If you use them for casual shorts and are someone who is used to that baggy look, or you are of the generation where you wear this type of short and expect a versatile baggy short, go up a size and you probably will want to cut / rip out the liner. If you plan to use them for training in the main square or in the yard, regular size will do.
