I am 5ft 3 inches and weighs 200lb post partum! . Waist 36" and hips 49" and I bought XL. It fits amazing! Even if you are a 38 waist you still can buy XL as it does have the right amount of stretch. The material is soft and very breathable. It is high waisted ( yes over the navel) and comfy- holds the tummy in and smooths out those love handles. It does not roll down. Your body feels nice and firm! This is by far my favorite. This reaches about an inch above my knee. I have thick thighs and it doesn't cut in and give that muffin look at the knees. This shorts does not ride up. I looove it. I have 2 pairs. A maroon/ burgundy ( very nice color) and gray! If you get your right size you wont regret it. I'll definitely buy a few more pairs.
