Is this device legal to sell?

Bought for my mum a little over a year ago for added security. This worked until October, I see Etrak no longer charging my account and their website is gone. I'm surprised they still sell it here. I was disappointed that neither the seller nor Etrak contacted me given the importance of the device. If my mother was hurt and needed me or my brother to help, it would prove useless. Luckily for everyone involved, that didn't happen.
