These leggings run small, my daughter loves the soft, stretchy jersey

So I ordered these for my daughter who will be 9 in 4 months. For the last four months she has been wearing size 10 pants from most brands. Currently her favorite color is black so I thought they would be great. I took a size 12 and decided it would fit her when she was 10 and found that even her favorite color isn't black anymore, black is still neutral. I know these pants are sold as school uniform pants, but even if she is allowed to be black at school, she is still not allowed to wear them as they have back patch pockets like jeans which is not allowed, nor are they allowed to wear leggings or yoga Pants and THIS PANTS FITS AS LEGGINGS. and 95% cotton/5% spandex stretch jersey. In this size 12, the waist was 11 inches flat side to side, unstretched, and the inseam was 25 inches. My daughter is tall for her age but for a size 12 to fit her now when she is not even 9 there is a problem with sizing with this brand! I am not dissatisfied with it, now she can wear it and loves it. BUT if you are purchasing these items LARGER than the size your daughter currently wears or asking what size you think you would like to order before ordering so that you know exactly what size you need. My daughter complained that the waist in them is too big but not enough that she can't wear them and she's skinny for her size but they haven't been washed or shrunk yet so I guess that's a little will help, I'm worried about the loss of length. UPDATE So after the first wash and dry they have shrunk at the waist by half an inch from side to side so they are full on all sides which is nice the problem is they shorten 1.5 inches in length . When my daughter tried them on again, she casually slipped her legs in and out and they were exactly where I wanted them. So I'm happy with it so far!
