Might be dirty! mine was!
For what I paid for I expected the item to be deleted. Are the directional buttons and the whole 3DS covered in orange juice I hope? Wear and tear on the device is acceptable, but getting a device that looks like a juice-covered kid is just ridiculous. There was also no SD card for the system, so be aware that it is required for gaming.
