This is normal. It's not panning no matter what others say! The seam on the bottom is not a swivel mechanism. When you tighten the side set screw, it grabs down with the cone head screw and pushes up to grab the ball mount and pinch it between the top and bottom. The plastic disc that comes into contact with the camera is really thin. It's good for time-lapse photography, however, or setting up a flash if you have a flash mouthpiece. You can't complain about the price, but it's only of limited use.
