Broken drive, damaged when first used

After many hours of transferring files to the flash drive, the drive failed for the first time. I can't put anything else on it without error 0x80070570. Files cannot be deleted from the hard drive. All attempts to recover the disk have failed. Files located on the hard drive will disappear randomly. I can't return the drive because some of the data is confidential so I'm losing the value of the drive. Buyer Warning.
