Poorly stitched on the shoe

The leather section that runs along the upper from the toe to the ribbing (for lack of a better word I call it the tongue) cuts into the top of my foot where it meets my ankle. Shoes are cut or made incorrectly for a number of reasons. 1.) The whole shoe is flat, doesn't stand up high enough and cuts into my foot where the red arrow is pointing in my picture. When I'm barefoot the elastic stretches to the limit, and with socks pulled that tight I think they'll break when I actually wear them anywhere. 2.) This tongue is too long, so the opening from heel to tongue is too small (green arrow). When I walk, bend my leg, or push my shin forward, it rests right on the joint of my ankle where it meets my leg. 3.) The torso (tongue) itself is flat. There should be an upward curve as you approach the ankle. (blue arrow) The curve is very small and not nearly the same as in the product sales image. Never had a problem with Skechers before. Length and width are perfect and comfortable except for the narrow tongue. Would have given 5 stars if the tongue was 1/2" shorter and/or a bit higher or had a more upward curve like my old pair. I considered trimming the elastic a bit to relieve tension but why should I have to do that with a brand new $70 pair of shoes.
