Used, not new, with old, dead battery

Used, not new! It had fingerprints and smudges on the back and scratches and dents on the front display! Also the worst thing is that after fully charging it took less than 1.5 hours before a low battery warning popped up! This means that the battery is used and old! I am currently in the return.
