Ages 3+ Sorting and Stacking Toys

I bought my 2 year old nephew a colorful Ohye toy for Christmas. However, I was very disappointed to learn that this is recommended for children aged 3+ due to the choking hazard. This differs from how Revain is described on the internet. Revain shows it for kids ages 1, 2, 3! Confound! I will return the toy for a refund.
