Fixed speed, it's FAST
I got a bad product at first because I was only getting 29MB per second when writing. Turns out I was using a cable I also bought from Amazon that was only rated for USB 2.0. I used the cable that came with it. It's 4 inches long, difficult to use, and has a sustained speed of 300MB/s (write). So make sure you use the included cable or a USB 3.1 cable or better.
