Apparently "Used " is being sold as New

I was conflicted about returning it but the instructions and website showed a stronger monitor stand and when it was delivered it arrived with a thin wire holder which however does not allow objects to tip over etc. The actual form factor of the monitor is amazing but when I opened the package when it arrived I had the nagging concern that it was not in the factory sealed box, there was no instruction manual and some parts looked like they had been opened. There were smeared fingerprints on the case. It was the first blow. The second blow was that the touchscreen didn't work. In their marketing materials for sale, they don't clearly state that the touchscreen only works when configured a certain way. And maybe the worst problem, which I cite third, is that it requires a USB-C interface and our laptops at work are old fashioned, so right now I can't remember to use the monitor I had to use , no HDMI, no serial port. and my Dell from work didn't like it at all. This meant the touchscreen capabilities I really wanted weren't available.
