I ordered a 'new' one for my 2 year old who is obsessed with Spiderman. On arrival it looked untouched and had tags. It wasn't until I cut through the tags and tucked my child in that I realized the left leg had an elasticated leg hole cut into the mesh underneath. I've seen reviews that say the elastic digs into baby's leg. I suspect I received a pair that someone cut out but then came back without cutting the second leg hole. My child didn't seem to mind the elasticated leg opening on one side and the loose leg opening on the other. He's still wearing a swim diaper. And I don't care about return issues. So I kept it.
