Too big and uncomfortable

This left marks on the inside of my son's elbows. Now he has to wear long sleeves and trousers to protect his skin from protective gear. He doesn't speak, so he couldn't tell me it cut his skin until we saw the scratches and scabs. This was his first time riding a scooter and he loves the scooter but would rather not ride it than wear pads. Supposedly it's for a toddler, but it's too big to fit comfortably. The pads all had velcro to keep them tight enough to stay on. The wrist guards are now larger than his arms. The straps on the helmet hang an inch below his chin at their tightest position, allowing the helmet to fall off easily. For reference, my son is almost 5 years old, about 3ft 7 inches and 39 pounds. He is average compared to his preschool age peers. Toddler for me means an age of 2 to 5 years. I can't imagine this would fit a 3 year old.
