Inaccurate temp gauge

I bought this for my wife as a stocking filler. She used it twice and both times the temperature wasn't accurate. This indicates the meat is done, but when we cut the meat it's not done yet. I'm tired of returning it and it's outside the return window which is very disappointing. I want to make sure you buy this item to use it immediately so you know if it is correct or not and can return it if it is not. Using OXO to manufacture quality products is very disappointing.
